Department Of Justice Sues Texas Over Abortion Law

With the State of Texas banning all abortions, many Democratic strongholds around the country have stood up in defiance. While turning their back on the state and calling for its citizens to flee, Democrats have also demanded that actions be taken under the grounds that no government should have control over what a woman or person be allowed to do with their own body. Now, the Department of Justice is suing the state of Texas, claiming the abortion ban is in direct conflict with the Constitution. 

According to the lawsuit, which was filed on Thursday, the Department of Justice believes the new law infringes on the constitutional rights of women and even violates the Supremacy Clause of the Constitution. Attorney General Merrick Garland, who is working close to the case, said it would  “deprive their citizens of their constitutional rights.” 

The lawsuit states, “It is settled constitutional law that ‘a State may not prohibit any woman from making the ultimate decision to terminate her pregnancy before viability.’ But Texas has done just that.”

But the suit being brought forth by the DOJ doesn’t just seek to dismiss the abortion law altogether, it also hopes to prohibit any person from bringing a lawsuit against a woman trying to receive an abortion. As of right now, a whistleblower could be entitled to almost $10,000 in damages if they turn over a person guilty of trying to get an abortion. 

Attorney General Merrick Garland told reporters, “The statute deputizes all private citizens, without any showing of personal connection or injury, to serve as bounty hunters authorized to recover at least $10,000 per claim from individuals who facilitate a woman’s exercise of her constitutional rights. The obvious and expressly acknowledged intention of this statutory scheme is to prevent women from exercising their constitutional rights by thwarting judicial review.”

While Governor Greg Abbott has been rather silent on the matter, Renae Eze, a spokesperson for the Governor, said that Abbott and his office were confident the courts would uphold their law. She added, “The most precious freedom is life itself. Texas passed a law that ensures that the life of every child with a heartbeat will be spared from the ravages of abortion.”
