Former Special Counsel Jack Smith appeared before the Senate Judiciary Committee on Tuesday and defended his federal criminal investigation into President Trump.
The hearing quickly became explosive when Republican Senator Ted Cruz confronted Smith over what Cruz described as a politically weaponized prosecution, as reported [1] by The Gateway Pundit.
Merrick Garland, who served as US Attorney General under Biden, appointed Smith to investigate Trump in November 2022.
That appointment came just one day after Trump announced his campaign for the White House in 2024.
The timing of the appointment became part of the broader criticism surrounding Smith’s investigation.
Cruz used his questioning Tuesday to portray Smith as a willing participant in an effort by the Justice Department to target a political opponent.
In June 2023, Smith indicted Trump on 37 federal counts in Miami.
The case concerned Trump’s lawful storage of presidential records at his Mar-a-Lago estate, which was protected by Secret Service agents.
Smith also pursued a separate case against Trump in Washington, DC. That indictment charged Trump with four counts connected to his actions surrounding an official proceeding and the federal government.
The four charges were conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
Together, the two cases placed Smith at the center of the federal effort against Trump.
During Tuesday’s testimony, Smith defended his investigation and prosecution. He also said that he continues to stand by his decision to bring criminal charges against President Trump.
Cruz was having none of that defense. The Republican senator accused Smith of an “egregious abuse of power” and delivered a blistering comparison to figures associated with the Nixon era.
“Congratulations! Because you have succeeded where Richard Nixon failed, which is weaponizing the DOJ to go after your political opponents! You are stepping into the shoes of John Mitchell…your abuses are far greater,” Ted Cruz said.
The senator’s attack focused squarely on Smith’s handling of the Justice Department and the political consequences of the prosecutions.
Cruz argued that Smith had achieved what Nixon could not by using the department against political opposition.
Cruz then mocked the praise Smith has received from opponents of Trump.
“For the rest of your life, you’ll be hailed as a hero in the resistance movement. I presume you have a pink hat somewhere at home,” Cruz said.
The senator followed that jab with a direct accusation that Smith had damaged the Justice Department’s standing.
He said Smith had abandoned the expectation that federal law enforcement remain removed from partisan political operations.
He continued, “But you have brought the DOJ into disrepute. Instead of being apolitical and enforcing the law, you willingly conscripted as a foot soldier as the DNC.”
Cruz also argued that Smith’s aggressive pursuit of Trump produced the opposite political result from what Trump’s opponents wanted.
According to Cruz, voters rejected the spectacle created by the federal cases and responded by returning Trump to office.
“And you reelected Donald Trump, because the people were disgusted at you,” Ted Cruz said.
Later in the hearing, Cruz delivered his broadest condemnation of Smith’s conduct. He characterized the former special counsel’s actions as an abuse without precedent in the history of the Justice Department.
“I believe his conduct represents the most egregious abuse of power in the history of the Department of Justice,” Ted Cruz later said.

Smith’s testimony showed that he remained committed to his decision to charge Trump, even as Cruz relentlessly challenged the legitimacy and political character of the investigation.
The exchange placed Smith’s record, Garland’s appointment, and the federal prosecutions of Trump under sharp Senate scrutiny.
