Fauci appeared before the committee under subpoena on Wednesday, July 29, after lawmakers sought testimony regarding decisions made during the federal government's response to the COVID-19 pandemic.

During the hearing, Fauci invoked his Fifth Amendment rights multiple times when questioned by senators. According to the source material, he declined to answer questions on 111 occasions.

Following the hearing, Birx discussed pandemic policies and argued that politics influenced how some states responded during 2020.

"There were solutions, but it became very political, and we all have to be aware, because it was a presidential election year," Birx said during her interview with Newsmax.

She continued, "It was really important for blue states to show that they were taking this very seriously, and they overclosed. And we just have to be honest that that happened!"

Birx served as the White House Coronavirus Response Coordinator during the Trump administration and became one of the most recognizable public health officials during the pandemic.

She frequently appeared alongside other federal officials during White House briefings to discuss recommendations related to masking, social distancing, and other mitigation efforts.

Her comments came just days after Fauci's appearance before the Senate committee, where lawmakers questioned him about various aspects of the federal pandemic response. The hearing focused on government decision-making during COVID-19 and related public health policies.

Birx's remarks represent one of the most direct public criticisms she has made regarding the response of states that maintained extended restrictions during the pandemic. She argued that political considerations affected decisions made by some state governments, particularly during the presidential election year.

The renewed attention on pandemic-era policies also follows legal actions initiated by several states in 2025. According to the source material, attorneys general from seven states submitted criminal referral letters naming Fauci, Birx, and several current and former public health officials.

Individuals identified in those referrals include former CDC Directors Dr. Rochelle Walensky and Dr. Robert Redfield, former NIH Director Dr. Francis Collins, NIAID Deputy Director Dr. Cliff Lane, former FDA Commissioner Dr. Stephen Hahn, FDA Principal Deputy Commissioner Dr. Janet Woodcock, Dr. Peter Hotez, EcoHealth Alliance President Dr. Peter Daszak, University of North Carolina virologist Dr. Ralph Baric, former BARDA Director Dr. Rick Bright, and hospital administrators and care providers in Arizona and Pennsylvania.

According to the referral letters, the allegations include murder, negligent homicide, involuntary manslaughter, medical coercion and abuse, kidnapping, human trafficking for forced labor, racketeering, operating a corrupt organization, and terrorism.

Criminal referral letters are requests for law enforcement authorities to review allegations and do not constitute criminal charges or findings of guilt.

The Senate hearing and Birx's subsequent interview have renewed debate over federal and state responses to the COVID-19 pandemic.

Lawmakers continue examining decisions made by public health officials, while former members of the White House Coronavirus Task Force have offered differing assessments of the policies implemented during the public health emergency.
